Neighbourhood Plan Screening Decisions Issued

A neighbourhood plan must be compatible with European Union obligations, as incorporated into UK law, in order to be legally compliant.

During the production of a neighbourhood plan, it is necessary for the plan maker (the qualifying body) to provide sufficient information for the responsible authority (the local authority) to determine whether an environmental assessment is required.

The information below highlights those decisions that have been issued for all those where opinions have been requested and determined by Woking Borough Council since neighbourhood planning began in the Borough.

Issued Screening Determinations

Hook Heath Neighbourhood Forum

On 13 June 2014, Hook Heath Neighbourhood Forum (HHNF) wrote to Woking Borough Council to formally request a Screening Opinion for the need to carry out a Strategic Environmental Assessment, Habitat Regulations Assessment and Environmental Impact Assessment on their emerging neighbourhood plan.

The following Screening Report, dated 22 August 2014, provides a detailed screening assessment and sets out the Council's final determinations, including a statement of its reasons for the determinations. In forming its determinations, the Council consulted the three statutory consultation bodies designated in the Regulations (English Heritage, Environment Agency and Natural England) on whether environmental assessment is required.

Pyrford Neighbourhood Forum

On 22 December 2015, Pyrford Neighbourhood Forum (PNF) wrote to Woking Borough Council to formally request a Screening Opinion for the need to carry out a Strategic Environmental Assessment, Habitat Regulations Assessment and Environmental Impact Assessment on their emerging neighbourhood plan.

The following Screening Report, dated 16 February 2016, provides a detailed screening assessment and sets out the Council's final determinations, including a statement of its reasons for the determinations. In forming its determinations, the Council consulted the three statutory consultation bodies designated in the Regulations (Historic England, Environment Agency and Natural England) on whether environmental assessment is required.

West Byfleet Neighbourhood Forum

On 1st August 2016, West Byfleet Neighbourhood Forum wrote to Woking Borough Council to formally request a Screening Opinion for the need to carry out a Strategic Environmental Assessment, Habitat Regulations Assessment and Environmental Impact Assessment on their emerging neighbourhood plan.

The following Screening Report, dated 2nd September 2016, provides a detailed screening assessment and sets out the Council's final determinations, including a statement of its reasons for the determinations. In forming its determinations, the Council consulted the three statutory consultation bodies designated in the Regulations (Historic England, Environment Agency and Natural England) on whether an environmental assessment is required. Following receipt of the draft West Byfleet Neighbourhood Plan in December 2016 and having considered the new and amended policies, the Council has prepared a letter setting out the impact on the Screening Opinion.
