Applications from individuals to purchase housing land and garages

1. Statement of intent

1.1 This policy amalgamates previous Housing Management policies (52) Sale of Garages and (72) Applications to Purchase Housing Land.

1.2 Generally the Council does not object to the sale of plots of land provided that all the necessary checks have been carried out to ensure that there is no development potential or communal amenity value.

1.3 Land must be surplus to to the Council's Services requirements before the sale can be approved.

1.4 The Council wishes to retain its stock of garages to provide secure parking for its Tenants and other residents. It would not generally wish to sell its garages unless required to do so under Right-To-Buy rules or if the garage site offered the potential for development of social housing.

1.5 Where the Council decides to sell their land or garage it will normally seek to achieve the best price.

2. Details

2.1 Any request to purchase land must include details of the proposed use of the land. If future housing development potential or communal amenity value is identified the request will be declined. If the site shows development potential for the individual, but not for the Council, disposal might still be reasonable with the potential reflected in the price.

2.2 After the completion of the investigations, the Housing Manager approves any application to purchase land if they have no development potential or communal amenity value having considered officers recommendations.

2.3 The Director then approves any terms and conditions of sales.

3. Key targets / standards

3.1 Valuation Services will attempt to negotiate the best price in any sale.
